High Court Justice Chitapi has set January 23 as the date for judgement in which Walter Magaya is seeking to stop the January 25 ZIFA elections.
Magaya had put his nomination papers contesting for the ZIFA presidency.
He was disqualified from the elections by the ZIFA Ethics Committee for failing to meet the requirements for the positon as he lacked the prerequisite five O Levels to run for office.
The decision did not go down well with Yadah FC owner prompting him to approach the courts.
After pre-trial in Justice Chitapi’s chambers the mattter was put for hearing.
It became a clash of the best legal minds in the land as Advocate Thabani Mpofu representing Magaya took on Proffessor Lovemore Madhuku representing ZIFA.
Advocate Mpofu said there was need for a fair ground in the ZIFA elections.
“Let people contest each other and let the best candidate win. I stand before your Lordship to say the candidate must be given the opportunity to show he is best for the job
“If the Constitution says you need to be 40 years to be President and I am 42, I am not overqualified, I am qualified,” argued Mpofu.
In response Madhuku stated that the case had been brought to wrong court before asking Magaya to produce his O Level certificate.
“The general principle of sporting activities is that their decisions must be left to sporting bodies.
“The applicant (Magaya) clearly has no case. You can’t qualify unless you have O level or equivalent. My learned colleague says you can have something higher than O level. The real issue is that he didn’t have O level. If he had O level he would have attached to the application. The logic of this you must have O level. The O level is the primary requirement needed.
“Magaya must show evidence that he attended High school,” said Madhuku.
